CU.Office Berlin Terms and Conditions
These Terms and Conditions apply to services provided within the premises of CU.Office Berlin ("Operator") and to each user of the premises ("Member"). Conflicting terms of the Member do not apply unless expressly confirmed in writing by the Operator.
1. Scope of services
Members may use an available workspace at Genter Straße 56, 13353 Berlin according to their booked package (fixed desk or flex desk, subject to availability). Unless otherwise agreed in writing, services include internet access, electricity, shared kitchen basics (water, tea, coffee) and use of shared spaces under the applicable house rules.
2. Prices, credits and payment terms
The Member plan costs 60 EUR net per month and includes 40 credits per calendar month. One hour at a Flex Desk costs 1 credit, one hour in the Meeting Room 5 credits; the minimum booking is 2 hours. Credits are charged once the booked time has taken place. Unused credits expire at the end of the month and are not carried over. In the first month of membership, credits are granted pro rata, but at least 20.
Bookings beyond the included credits remain possible. Each additional credit costs 1.00 EUR net. Additional credits are invoiced in arrears; amounts below 50 EUR may be carried over and invoiced later.
The Fixed Desk add-on costs 130 EUR net per month, the Mail Address add-on 10 EUR net per month. The Friend plan costs 5 EUR net per month and does not include credits; Friends may book the Meeting Room for 15 EUR net per hour (minimum 4 hours), invoiced in arrears; amounts below 100 EUR may be carried over and invoiced later. A reduced Member fee of 50 EUR net per month is available on request to students, senior citizens and job seekers.
Flex Desk bookings can be cancelled free of charge up to 1 hour, Meeting Room bookings up to 6 hours before they start; after that, the credits or fees remain due.
Fees are invoiced monthly in advance by e-mail and are due within 10 days from invoice date unless stated otherwise on the invoice. The first month of a Member plan is invoiced pro rata by days. Payments are accepted electronically. If an invoice is overdue by more than 30 days, the Operator may suspend the Member's ability to book until it is paid.
2a. Account, approval and the CU.App
Membership is managed in the CU.App (app.ceeju.io). Registration requires approval by the Operator, usually after a trial day; there is no entitlement to admission. Members sign in with a one-time code sent to their e-mail address and are responsible for keeping that mailbox secure.
A Member's profile (name, photo, short text, skills) is visible to other approved Members and can be hidden in the profile settings.
By agreement with the Operator, several persons may book from the credits of one paying Member; the paying Member is liable for their bookings.
3. Access, personal use and guests
Access credentials (keys, codes, app access) are personal and must not be shared. Door access is provided as a personal electronic key and ends with the membership. Membership is personal and non-transferable. Members are responsible for their guests, employees, contractors and other persons they bring into the space.
4. Security obligations and incident reporting
Members must comply with all security rules in the house rules, including closing and locking windows and doors when leaving, protecting access credentials, and reporting incidents, break-ins, lost keys, or security-relevant events without undue delay.
5. Insurance
The Operator maintains business insurance coverage in its own name as part of its operational risk management. The exact scope and limits depend on the active insurance policies.
Each Member must maintain adequate insurance coverage for the duration of their membership. This must include business or professional liability insurance (Betriebs- oder Berufshaftpflichtversicherung) with coverage for damage to commercially used premises (Mietsachschaden). Upon request, the Member must provide the Operator with proof of valid insurance. Private liability policies generally do not cover professional or commercial activity and are not sufficient.
6. Liability of the Operator
The Operator has unlimited liability for intent and gross negligence, and for injury to life, body, or health.
In case of slightly negligent breach of essential contractual obligations (cardinal obligations), liability is limited to the foreseeable, typically occurring damage.
In all other cases, liability for slight negligence is excluded to the extent permitted by law. Mandatory statutory liability remains unaffected.
7. Liability of the Member
The Member is liable for all damages to rooms, infrastructure, equipment or handed-over items caused culpably by the Member, their employees, guests, contractors or other vicarious agents. This includes in particular damages caused by negligence (Fahrlässigkeit) or non-compliance with security obligations and house rules.
8. No custody obligation for Member property
Guarding, monitoring, safekeeping and insurance coverage for personal property of Members are not part of the contract. Any video surveillance, access systems, or on-site presence do not create a custody obligation for Member property.
9. Termination
Membership may be terminated by either party in the CU.App or in text form. The termination takes effect at the end of the month following the notice (for example: notice on 1 September, membership ends on 31 October). If the Member has an active Fixed Desk and/or Mail Address add-on at the time notice is received, the notice period is three months to the end of a month. Instead of terminating, Members may switch to the Friend plan; the switch takes effect with the same notice periods as a termination and can be withdrawn until then. Switching from Friend to Member and adding add-ons is possible at any time with immediate effect.
10. Final provisions
If individual clauses are invalid, the remainder of the contract remains effective. Mandatory statutory provisions remain unaffected.
