CU.Office Berlin Terms and Conditions
These Terms and Conditions apply to services provided within the premises of CU.Office Berlin ("Operator") and to each user of the premises ("Member"). Conflicting terms of the Member do not apply unless expressly confirmed in writing by the Operator.
1. Scope of services
Members may use an available workspace at Genter Strasse 56, 13353 Berlin according to their booked package (fixed desk or flex desk, subject to availability). Unless otherwise agreed in writing, services include internet access, electricity, shared kitchen basics (water, tea, coffee) and use of shared spaces under the applicable house rules.
2. Prices and payment terms
Current standard pricing is 60 EUR net/month for the Member plan, including 40 credits. This equals up to 40 hours Flex Desk or 8 hours Meeting Room. The Fixed Desk add-on costs 130 EUR net/month, the Mail Address add-on 10 EUR net/month, the Friend plan 5 EUR net/month, and a reduced Member fee may be agreed at 40 EUR net/month. Fees are invoiced monthly in advance and are due within 7 days from invoice date unless stated otherwise on the invoice. Payments are accepted electronically.
3. Access, personal use and guests
Access credentials (keys, codes, app access) are personal and must not be shared. Membership is personal and non-transferable. Members are responsible for their guests, employees, contractors and other persons they bring into the space.
4. Security obligations and incident reporting
Members must comply with all security rules in the house rules, including closing and locking windows and doors when leaving, protecting access credentials, and reporting incidents, break-ins, lost keys, or security-relevant events without undue delay.
5. Insurance
The Operator maintains business insurance coverage in its own name as part of its operational risk management. The exact scope and limits depend on the active insurance policies.
Each Member must maintain adequate insurance coverage for the duration of their membership. This must include business or professional liability insurance (Betriebs- oder Berufshaftpflichtversicherung) with coverage for damage to commercially used premises (Mietsachschaden). Upon request, the Member must provide the Operator with proof of valid insurance. Private liability policies generally do not cover professional or commercial activity and are not sufficient.
6. Liability of the Operator
The Operator has unlimited liability for intent and gross negligence, and for injury to life, body, or health.
In case of slightly negligent breach of essential contractual obligations (cardinal obligations), liability is limited to the foreseeable, typically occurring damage.
In all other cases, liability for slight negligence is excluded to the extent permitted by law. Mandatory statutory liability remains unaffected.
7. Liability of the Member
The Member is liable for all damages to rooms, infrastructure, equipment or handed-over items caused culpably by the Member, their employees, guests, contractors or other vicarious agents. This includes in particular damages caused by negligence (Fahrlässigkeit) or non-compliance with security obligations and house rules.
8. No custody obligation for Member property
Guarding, monitoring, safekeeping and insurance coverage for personal property of Members are not part of the contract. Any video surveillance, access systems, or on-site presence do not create a custody obligation for Member property.
9. Termination
Membership may be terminated by either party with 30 days' notice. If the Member has an active Fixed Desk and/or Mail Address add-on at the time notice is received, the applicable notice period is 90 days.
10. Final provisions
If individual clauses are invalid, the remainder of the contract remains effective. Mandatory statutory provisions remain unaffected.
